Referred to below as “AFACIAL” or “we”.
Full disclosure in the imprint. The general terms and conditions of the studio apply in addition; if they contradict each other, these laser specific terms prevail.
§ 1 Scope
1.1 These terms and conditions (the “Terms”) govern the contractual relationship between AFACIAL and natural persons (the “member”) who take out one of the three AFACIAL laser flat rate memberships (Essential, Signature, VIP).
1.2 By taking out the membership (online at afacial.at, on site in the studio or by written registration) the member confirms that they have read, understood and accepted these Terms.
1.3 Terms that differ from, contradict or add to these Terms become part of the contract only with the express written consent of AFACIAL.
§ 2 Services covered by the membership
2.1 Depending on the tier chosen, the membership covers the following laser hair removal treatments with a modern diode laser at the AFACIAL studio:
- Essential, €99 per month: underarms, bikini line, upper lip
- Signature, €149 per month: underarms, bikini line, full intimate area, buttock crease, upper lip, chin
- VIP, €219 per month: underarms, bikini line, full intimate area, buttock crease, full legs, full face, abdominal line
All prices include 20% VAT.
2.2 Within the chosen membership the member can have an unlimited number of treatments of the included zones, each of them within the medically sensible treatment interval of 4 to 8 weeks per zone. These intervals serve the treatment result and skin health and are set individually by our specialists.
2.3 There are no surcharges on site for the zones included in the membership.
2.4 Not included are treatments of other zones, other AFACIAL services (for example facial treatments, microneedling) and products. The member can book and pay for these separately.
2.5 The membership is not a treatment package with a session credit. Sessions that have not been used expire at the end of every calendar month. Transferring, paying out or offsetting them is excluded.
§ 3 Minimum term and termination
3.1 The membership has a minimum term of twelve (12) consecutive months from the date on which the contract starts.
3.2 After the minimum term the membership is automatically extended for an indefinite period and can be terminated by ordinary notice of one (1) month to the end of a month.
3.3 The termination has to be in text form (e-mail to info@afacial.at or in writing to the address given above) and has to identify the membership details clearly.
3.4 Extraordinary termination for good cause (in particular a permanent medical impediment with a doctor’s confirmation, a permanent move away from Vienna of more than 50 km, or a serious breach of contract by AFACIAL) remains open to both sides.
3.5 Termination within the minimum term is excluded, except in the case of § 3.4. Contributions already paid are not refunded (see also § 9).
§ 4 Right of withdrawal for online registration
4.1 If the member has taken out the membership at a distance (for example through the website afacial.at), they have a statutory right of withdrawal under § 11 FAGG.
4.2 Withdrawal period: fourteen (14) days from the day on which the contract is concluded.
4.3 Exercising the withdrawal: by an unambiguous declaration in text form (e-mail to info@afacial.at) stating the membership details. The member can use the model withdrawal form provided by AFACIAL but is not obliged to do so.
4.4 Start of the treatment before the withdrawal period ends: if the member wants treatments within the 14 day withdrawal period, they have to ask expressly for AFACIAL to begin providing the services before the withdrawal period ends, and confirm that they lose the right of withdrawal once the service has been provided in full. If the services are used in part, the member keeps the proportionate right of withdrawal; in that case the value of the services already provided has to be paid at the regular single session price.
4.5 The right of withdrawal does not lapse for contracts that are concluded directly in the studio, but the regular statutory provisions apply there.
§ 5 Membership fee, payment and default
5.1 The monthly membership fee is collected from the bank account provided by SEPA direct debit. As an alternative, payment in advance by bank transfer can be agreed.
5.2 The fee is debited monthly in advance on the same calendar day on which the membership originally started (or, if that day does not exist in the month in question, on the last day of the month).
5.3 The member has to keep current and correct payment details on file and to report any change without delay.
5.4 In case of default (for example a returned direct debit, a declined card), the membership services are suspended from the following day until payment has been made in full. The member bears any return debit and reminder fees within the statutory limits.
5.5 If payment is more than 30 days overdue, AFACIAL is entitled to terminate the membership without notice. Fee claims that have already arisen remain due in full.
§ 6 Non-transferability
6.1 The membership is personal and non-transferable. It may be used only by the registered person.
6.2 Passing on individual treatments or the membership as a whole, or use by third parties, is excluded.
§ 7 Booking and cancelling appointments
7.1 Treatment appointments have to be booked in good time in advance, primarily online through the AFACIAL booking system (Salonkee), by WhatsApp or by phone.
7.2 Appointments are allocated subject to availability. For reasons of capacity we cannot guarantee that every preferred appointment is available immediately.
7.3 Cancellation and rescheduling period: 48 hours before the appointment starts. Appointments that are not cancelled or rescheduled within this period, and appointments that are missed without notice (“no show”), are charged at 50% of the regular single session price of the booked zone and have to be paid separately from the membership fee.
7.4 The charge under § 7.3 is not a penalty; it compensates for treatment time that can no longer be given to somebody else.
7.5 In justified exceptional cases (illness with a doctor’s confirmation, force majeure) AFACIAL can waive the cancellation fee at its own discretion.
§ 8 Pause for medical reasons
8.1 Requirement: the member can pause the membership on written request if there is a medical reason that makes using the services impossible or unreasonable. This includes in particular pregnancy, breastfeeding, acute skin diseases in the treatment area, photosensitising medication or treatment breaks ordered by a doctor.
8.2 Documents required:
- a doctor’s confirmation stating the medical reason (without details of the diagnosis, unless they are strictly necessary),
- the expected duration of the impediment,
- a way to contact the doctor who issued it, for verification.
8.3 How to apply: in writing by e-mail to info@afacial.at, at least seven (7) days before the desired start of the pause (except in case of an acute medical impediment).
8.4 Duration:
- First pause: up to three (3) months.
- An extension is possible with an updated doctor’s confirmation.
- Pauses for pregnancy or breastfeeding: up to twelve (12) months at a time.
8.5 Status during the pause:
- Access to the membership services is suspended.
- No monthly fees are collected.
- The minimum term is extended by the duration of the pause.
- The tariff at the time the pause starts is kept after the membership is resumed, even if prices have been adjusted in the meantime.
8.6 Resumption:
- automatically once the approved pause period is over,
- earlier resumption is possible at any time on written request.
8.7 A pause for personal, professional, holiday or financial reasons is not possible under this provision.
§ 9 No refunds
9.1 Membership fees are not refundable, not even for treatments that have not been used, for paused months (where the medical reasons are assessed differently afterwards) or for terminations within the minimum term.
9.2 Statutory refund claims under the right of withdrawal (§ 4) and under extraordinary termination (§ 3.4) remain unaffected.
§ 10 Contraindications, duty to inform and cooperation
10.1 Before the first treatment there is a free consultation with a skin analysis. Together we check suitability, skin type and possible contraindications.
10.2 The member has to give truthful information about previous illnesses, skin diseases, medication (in particular photosensitising medication), pregnancy, previous aesthetic treatments and allergic reactions.
10.3 Before every session:
- 24 hours before: shave the zone to be treated (do not pluck, do not wax, do not epilate).
- 3 weeks before: no pulling out hair with the root, no waxing, no epilation.
- 1 week before: no sunbathing, no solarium, no self tanner.
- Report any change in your state of health or in your medication.
10.4 After every session:
- 1 to 2 weeks of sun protection with a high sun protection factor (at least SPF 30, SPF 50 recommended).
- No sauna, no swimming pool, no intensive sport for 24 to 48 hours.
- Follow the individual care recommendations you were given.
10.5 AFACIAL reserves the right to refuse or postpone a treatment if medical reasons, skin related reasons or reasons the member is responsible for (for example a strong tan, fresh sunburn, incorrect preparation) make this necessary. Such a refusal does not count as non-performance for which AFACIAL is responsible.
§ 11 Result and liability
11.1 According to current medical knowledge, laser hair removal leads to a permanent hair reduction of 80 to 95%, depending on skin type, hair colour, hormone status and body zone. A 100% permanent removal of all hair cannot be guaranteed scientifically.
11.2 Occasional touch-up sessions can be necessary to keep the result in the long term.
11.3 AFACIAL is liable within the statutory limits for damage caused by gross negligence or intent on the part of its staff. Liability for slight negligence is excluded as far as the law allows. For consumers under the KSchG this limitation does not apply to personal injury.
11.4 AFACIAL accepts no liability for damage that arises from incorrect or incomplete information given by the member under § 10.
§ 12 Changes to fees and to these Terms
12.1 AFACIAL is entitled to adjust membership fees, included zones or individual provisions of these Terms with at least 30 days of advance notice in text form to the e-mail address on file.
12.2 In case of fee increases or material changes to the disadvantage of the member, the member has the right to terminate the membership extraordinarily with effect from the date on which the change takes effect. The termination has to be declared in writing within 30 days of the notification.
12.3 If no termination is declared within this period, the changed terms count as accepted.
§ 13 Data protection
13.1 AFACIAL processes the personal data of the member exclusively within the framework of the GDPR and Austrian data protection law.
13.2 Details of the data processing, of the rights of the member (access, rectification, erasure, withdrawal of consent, complaint to the data protection authority) and contact information can be found in the AFACIAL privacy policy.
13.3 Sensitive health data (for example a doctor’s confirmation for a medical pause) is processed exclusively for the agreed purpose, treated confidentially and deleted once that purpose has been fulfilled.
§ 14 Severability clause
14.1 Should individual provisions of these Terms be or become invalid, unenforceable or unlawful in whole or in part, the validity of the remaining provisions remains unaffected.
14.2 The invalid provision is replaced by the permissible rule that comes closest to the economic purpose of the invalid provision.
§ 15 Applicable law and place of jurisdiction
15.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the referral rules of private international law.
15.2 For consumers within the meaning of the KSchG, the statutory place of jurisdiction of their domicile, their habitual residence or their place of employment in Austria applies.
15.3 For entrepreneurs within the meaning of the UGB, the competent court in Vienna, Austria is agreed as the place of jurisdiction.
§ 16 Final provisions
16.1 The German version of these Terms is the legally binding version. Translations into other languages are for information purposes only.
16.2 There are no verbal side agreements. Changes or additions require text form.
